Online sports gambling was officially legalized in WV in 2018 after the conclusion of New Jersey’s lengthy legal battle against PASPA. At that time, BetLucky launched in WV and gamblers were able to place online sports bets there.

Sadly, BetLucky came under intense scrutiny and was forced to close less than six months after in launched in December 2018. Other retail sportsbooks in WV were also forced to paused their operations at that time and have yet to reopen.

West Virginia Online Casino

Iowa Online Sports Betting

Iowa passed a bill legalizing online sports gambling back in 2019. Known as Iowa House Bill 617, this legislation allowed for much faster turnaround than other states. Iowa launched its first internet sportsbooks just three months after that bill passed.

That said, Iowa did not skimp on the regulations despite the fast turnaround time. Iowa is one of the only internet sports betting states that requires players to register for betting accounts in-person. Players must register at physical casinos which are partnered with online sportsbooks. Gamblers in IA cannot register or create sportsbook accounts electronically.

The good news for players in Iowa is that this restriction will be lifted in 2020. Players will soon be able to create accounts at sportsbooks online without going to physical casinos.

Nevada had a good thing going under PASPA. For almost 20 years, this bill gave only a select few US states permission to allow legal sports betting. Nevada was one of those states. This made the state’s sports betting industry highly lucrative.

When PASPA was declared unconstitutional in 2018, other states could legalize sports betting too. That said, Nevada still holds the crown. Today, the majority of lines, estimates and spreads used for online sports gambling come directly from Nevada sportsbooks.

Nevada does have some online sportsbook rules you should be aware of. The state is actually similar to Iowa in that it requires new players to sign up in-person at a physical casino in order to create a new account. Unlike Iowa, Nevada has no plans to change this law as of right now.

  • William Hill: This sportsbook maintains one of the largest betting networks on Earth today. You can find William Hill sportsbooks at many Las Vegas casinos. Oregon was one of the few US states that was legally allowed to offer sports betting under PASPA. The state has a strong network of physical and online sports betting sites. Oregon does not offer other types of gambling online.

Oregon launched online sports gambling shortly after PASPA was overturned. The first online sportsbook in Oregon debuted in fall 2019. At that time, the Oregon Lottery launched a sports betting app called Scorecard which was developed by SBTech.

Online sports gambling in Oregon is regulated by the state lottery. With sports betting the lottery moved forward without passing any additional legislation. The organization felt that, because sports betting in Oregon was legal under PASPA, it was safe to launch the practice without additional laws in place.

As of now this strategy appears to be working in Oregon. The state has seen no legal challenges to its online betting practices.

The state’s legal physical casinos are now free to launch sportsbooks too. So far, just the Chinook Winds Casino has done so. There are plenty more tribal casinos in Oregon too, but no others have launched sportsbooks yet.

Many have speculated that as time goes on, sports betting in Oregon could grow widely. The lottery currently holds all the power when it comes to the regulation of Oregon sports betting. Many believe that one day the lottery might allow sports betting anywhere that lottery tickets are sold.

There is currently just one online sportsbook in Oregon:

  • Oregon Lottery Scorecard: The Oregon Lottery controls this app. It was launched in the fall of 2019. This app has options for multiple different live sports bets as well as a wide variety of different sports to choose from.

Oregon Retail Sportsbooks

A variety of tribal casinos has Oregon, but so far only the Chinook Winds Casino has debuted a sportsbook.

Oregon Online Casinos

Oregon is one of those states where gambling is illegal, at least at casino websites. The state has no provisions in its laws for legal gambling online at US gambling sites. The only legal online gambling allowed in this US state is online sports betting through the state lottery’s app. There is no upcoming legislation to legalize online casinos in Oregon at this time.

Oregon Online Poker

The story here is much the same as Oregon’s online casino policy. Online poker is not legal in Oregon. There are no plans to allow it in the state anytime soon.

Rhode Island Online Gambling

Rhode Island has legalized online sports gambling, but the process has been slow. At this time, no online gambling sites have launched yet in RI but you can be sure that they are coming soon.

Rhode Island quietly legalized sports betting in late 2018 and almost no one realized it. The state included a provision for sportsbooks in its 2018 budget proposal. Sports betting was legalized in the state with the passage of this budget. RI made the first legal bet in November 2018.

Soon after the first legal bet took place, RI lawmakers added a provision to the existing law that also legalized online sports gambling. The state’s casinos were quick to launch their own US gambling sites for sports betting. Twin River Lincoln was the first to launch in fall 2019 and Twin River Tiverton launched its service soon after.

Unlike most other legal online sports betting states in the US, Rohde Island takes more than half of the revenue generated from both physical and online sportsbooks. The state’s casinos receive roughly only 20% of the revenue they generate through sports betting. The remaining profit goes to technology company IGT which maintains close connections with the state government and its casinos.

Only two physical casinos in RI offer retail sports betting:

Rhode Island Online Casinos

Rhode Island currently has no legal online betting at casinos. The state has no upcoming plans to legalize online casino gambling. Gamblers in Rhode Island who wish to play real money online casino games must use sweepstakes-style US gambling sites.

Rhode Island Online Poker

Rhode Island has no plans for legal online poker in the near future. There are no currently legal online gambling sites for poker in RI. That said, gamblers can find some Rhode Island online poker options at sweepstakes-style US gambling sites that accept US players.

Michigan Online Gambling

This makes Michigan one of the few US states to offer online casino games like video poker and slots, roulette, blackjack, and more in addition to sports betting online. Dedicated US gambling sites for poker also exist in Michigan.

As part of Michigan’s online gambling legislation, gambling operators are only allowed one online gambling site each. Additionally, games that cross state lines are prohibited. That means you can only play games for real money against other players in Michigan

Every Michigan casino can apply for online gambling licenses. That includes all the state’s 23 tribal casinos as well as 3 corporate casinos. Licensing fees apply and ensure that only reputable casinos have access to online gambling USA. Current Michigan online gambling license fees are $50,000 for license application, $100,000 for the license itself, and $50,000 for annual license renewal.

Washington DC Online Gambling

While it isn’t a true state, Washington DC is allowed to make its own gambling laws. The city’s mayor is able to sign off on gambling legislation for the city. When the bill crossed the desk of Mayor Muriel Bowser in January 2019, it was not signed but was given enough time to become law since no veto was made.

After this bill passed, there was a bit of delay as infrastructure and industry caught up. The first online sportsbook in Washington DC debuted on May 2020. Known as Gambit DC, the platform has no mobile app and is only accessible via web browsers. To this day, Gambet DC is the only internet sportsbook in Washington DC. Several more are coming soon but they are still undergoing approval.

Pennsylvania Online Gambling

PA expanded its online gambling site options when a law was passed back in 2017 that allowed internet casino gambling. Since then, the state’s land-based casinos have been relatively quick to react. Competition from neighboring New Jersey has fostered fast growth of online wagering in both states. Players in the entire tri-state area have benefitted from this since you don’t need to be a resident of either state. You can gamble online in PA as long as you’re inside the state’s borders.

New Hampshire Sports Online Betting USA

New Hampshire’s first internet sportsbook launched in January 2020. Unlike most other states, NH allowed online sports gambling before retail sports betting was fully launched. Retail sportsbooks should follow soon and will likely be active by the end of 2020.

Funny enough, NH online sports betting was legalized only because Governor Chris Sununu wanted to place a bet on the New England Patriots during the 2019-2020 NFL season. Sununu pressured lawmakers to enact legislation that would allow him to place a bet on the team before the Super Bowl. Unfortunately for the governor, the Pats didn’t make it all the way during that season. Despite that, the rest of us get the benefit of internet sports betting in NH.

There is currently only one legal real money gambling site active in New Hampshire:

  • DraftKings: DraftKings temporarily holds a monopoly over NH online sports gambling. This is likely to end very soon as more sports betting titans enter the New Hampshire online gambling market. For now, players in NH must use DraftKings to place online sports bets.

New Hampshire Retail Sportsbooks

Online sportsbooks were given priority status in NH. No retail sportsbooks have launched yet in the state. That said, plans are in place for several retail sportsbooks to launch in New Hampshire by the end of 2020.

With that said, it’s important to note that retail sports betting can only occur in NH towns that have specifically approved them. This was added to state law in a November 2019 vote.

New Hampshire Online Casinos

There is no provision for legal online poker under NH state law. Players will need to use a sweepstakes-style gambling site in order to play online poker from within the state.

In fact, Delaware was the first state in the USA to launch legal sports betting after the US Supreme Court overturned PASPA in 2018. Delaware launched retail sports betting in June 2018. The state beat out New Jersey as the first in the country to launch by just a few weeks.

Delaware has just three land-based casinos but all of them now offer retails sportsbooks. Strangely for the USA gambling industry, these three casinos actually all share a joint license which is issued by the state lottery organization.

Online sportsbooks are technically legal in Delaware, but none have launched yet. We’re unsure if any are currently seeking approval from the state. None of Delaware’s three casinos have made any moves to launch online sports betting.

Colorado’s potential online gambling market is huge. With 33 casinos across the state, there will likely be a lot of competition for CO online sportsbooks in the near future.

Colorado does not allow online casino gambling. There are no plans for the state to legalize online casino gambling at this time. Gamblers in CO can still bet online at sweepstakes-style casinos.

Montana’s governor signed a bill in May 2019 which fully legalized sports betting across the state. Sports betting in Montana is currently managed by Inralot, a large lottery company. The law included provisions for both retail and online sportsbooks, but there are some strange restrictions concerning online sports betting.

To place sports bets online, gamblers in Montana must be located inside authorized betting sites including lottery retailers and specific bars or taverns. Outside of these specific locations, online sports bets cannot be placed in Montana.

Sports betting was legalized in Illinois after the passage of a bill in June 2019. It took almost a year to work out the kinks and get the industry setup in the state. Illinois sports betting officially launched in early summer 2020.

Rivers Casino became the first Illinois casino to launch an online sportsbook when it debuted BetRivers. This was the first-ever online sportsbook in Illinois.

Initially, Illinois state law required that players sign up for online sports betting accounts in-person at Illinois casinos. However, the COVID-19 pandemic forced the state’s governor to change this law. Gamblers in Illinois can now create online sportsbook accounts right over the internet.

Illinois has one of the steepest entry fees to online sports betting in the entire USA. Each sports betting license costs $10 million. That said, the market is potentially huge so expect several Illinois casinos to get onboard in the next few months.

US States Seeking to Legalize Online Gambling

Virigina has played around with the idea of legal sports betting for several years. No real action was taken on the matter until April 2020. At that time, lawmakers passed multiple bills with provisions to legalize and regulate both retail and online sports betting in Virginia.

Governor Ralph Northam was in favor of sports betting legalization in VA but did not immediately sign off on the proposed bills. Instead, he sent them back to lawmakers along with his own personal recommendations. These changes included more specific regulations surrounding the locations where retail bets can be placed. Gov. Northam also loosened restrictions on bets placed on Virginia college sports teams.

Once lawmakers made the changes than Governor Northam requested, sports betting became legal in Virginia. Official legalization took effect on July 1, 2020.

Tennessee Online Gambling

Tennessee passed legislation to legalize and regulate online sports betting back in April 2019. Unlike most other US states with legal sports betting, Tennessee has chosen to only allow internet sports betting. Retail sports betting will still be prohibited in Tennessee under the new gambling laws.

The first Tennessee online sportsbooks should launch by the end of 2020. The state will charge operators a $750,000 annual license fee. This should keep away the amateurs and ensure that only reputable online sportsbooks like FanDuel and DraftKings setup shop in TN.

Legal Retail Sports Betting in the USA

Many US states allow for legal retail or onsite sports betting without allowing internet sports betting. Below is a list of US states that have outlawed or severely restricted online sports betting but do allow retail sports betting.

New York, Arkansas & Mississippi

New York: NY jumped on the sports betting train in 2013 but could not officially legalize the practice until PASPA was overturned in 2018. As of today, there are seven retails sportsbooks currently active across NY. There’s also a chance that New York could legalize online sports betting in the near future. Check back regularly for updates.

Arkansas: Arkansas state law allows for legal retail sports betting. This has been the case since 2019. Currently, the state has just one retail sportsbook. It is located at the Oaklawn Racing Casino Resort. State laws does include provisions for three additional retail sportsbooks, but online sports betting is strictly prohibited.

Mississippi: This prominent southern state was one of the first to launch legal sports betting after PASPA was ruled unconstitutional. The state’s first retail sportsbook location opened in summer 2018. There are now well over a dozen legal sportsbooks operating in Mississippi. Online sports betting is actually legal in MS, but it’s only legal to place bets while physically located at a sanctioned gambling site.

New Mexico, North Carolina, Washington DC & Michigan

New Mexico: New Mexico sports betting falls into a strange grey area of US law. Sports betting is legal and active in the state at five tribal casinos. However, there is no specific state law in NM that makes this practice legal. Instead, the tribal casinos have asserted that they are free to enact sports betting as they please under their agreement with the state. There have been no serious legal challenges to this as of today.

North Carolina: This state specifically gave its tribal casinos permission to enact legal sports betting back in July 2019. That said, the process has been slow and there are still no active sportsbooks in NC. The state has not given any permission for casinos to launch online sportsbooks.

Washington DC: Although not a true US state, Washington DC is able to legalize sports betting within city limits. The city council actually approved a sports betting law back in winter 2018, but it’s since been blocked by a judge. There are currently no estimates for when this will be resolved.

Michigan: Michigan offers a lot of legal gambling options. Sports betting was legalized in the spring of 2020. Two casinos in MI now offer legal sportsbooks. Online sports betting has also been legalized, but no Michigan online sportsbooks have launched yet. Keep an eye out for upcoming online sportsbooks in Michigan.

US States Considering Legal Sports Betting

Not every US state is onboard with the idea of legal sports betting. Every state is unique. It’s reasonable to expect that not every US state will legalize sports betting.

Here is a list of states that are actively considering the decision:

California, Florida, Maine & Massachusetts

  • California: California was actually considering a ballot measure in November 2020 which would ask voters to decide the legality of sports betting in the state. Unfortunately, the coronavirus pandemic put a stop to that. The state has shifted its focus to other more important matters for the remainder of 2020.
  • Florida: It might surprise you that Florida has no current structure for legal sports betting. However, that could change soon. Lawmakers introduced multiple bills in 2020 seeking to legalize sports betting. So far, legislators have chosen to let the Florida Lottery control the practice. The state’s Seminole Tribe has yet to comment on the initiative.
  • Maine: Lawmakers in Maine tried to pass sports betting legislation in the summer of 2019. She passed a bill and submitted it to the governor, but she decided to veto it. As of now, there’s no timetable for legal sports betting in Maine.
  • Massachusetts: Legislators in the Commonwealth of Massachusetts are working to legalize sports betting. Several bills are now under review by the state governor. He has yet to approve anything, but there’s confidence in the industry. Most believe that it’s just a matter of time before the governor signs the bills into law.

Kentucky, Maryland, Missouri & Kansas

  • Kentucky: Kentucky has fought a long battle to legalize sports betting. It doesn’t appear to be ending anytime soon. Bills were presented during sessions in both 2019 and 2020, but nothing ever progressed. Whether KY lawmakers will seek again in 2021 remains to be seen.
  • Maryland: Maryland will ask voters to decide the legality of sports betting via a ballot initiative in November 2020. If voters approve this measure, it’s then up to state legislators to create a bill and fully legalize the practice.
  • Missouri: There is currently nothing on the agenda in Missouri concerning legalized sports betting. Lawmakers hope they can make some inroads next year.
  • Kansas: Kansas legislators currently have two bills going around which seek to legalize sports betting. Both the state Senate and House have created their own bills. The problem here is that the bills are each quite different from each other. This could make it difficult for lawmakers to find common ground.

Online Lottery in the USA

Very few states in the US currently offer internet lottery play. Most states still require that lottery play be done traditionally via physical lottery retailers. The following states allow some form of internet lottery play:

  • Georgia: This state’s lottery is run by the Georgia Lottery Corporation. Online lottery play is allowed anywhere in the state of Georgia. This has been legal since the fall of 2012. Players can legally buy tickets for draw games online.
  • Illinois: Illinois has offered internet lottery play since 2012. The state started by testing the waters with just Lotto and Mega Millions ticket sales online. Within a few months, more games were added. Today, the Illinois Lottery offers Powerball, Daily Lotto, and Instant Game tickets online.
  • Michigan: Michigan launched its online lottery in late 2014. Under this program, residents can purchase instant keno, Poweball, Mega Millions, and electronic scratch-off style tickets online. The only restrictions are that players be at least 18 years old and residents of Michigan.
  • Kentucky: Kentucky is one of the most recent US states to legalize online lottery ticket sales. This state passed legislation in 2016 that legalized online lottery play. Residents of KY can choose from jackpot, daily draw, and instant lottery games online.
  • New Hampshire: This state legalized online lottery in the fall of 2017. This was officially launched in September 2018.
  • Pennsylvania: This state offers gamblers a massive range of online gambling options. It’s unique in the tri-state area. It is one of the only mid-Atlantic states to offer internet lottery. PA online lottery was legalized in 2017. As of today, players can only buy instant win scratch-off style lottery tickets online. There is lots of room for expansion of this program under PA law.

US Daily Fantasy Sports

Daily fantasy sports (DFS) betting is a popular gambling option for sports-savvy gamblers. Many states allow this practice, but there are strict regulations in place.

New York initially was hostile to this practice. In 2015, New York Attorney-General Eric Schneiderman hit both DraftKings and FanDuel with a cease-and – desist order. At that time, it was unclear whether or not daily fantasy sports betting was actually legal under NY state law.

Legal proceedings between the state and both DraftKings and FanDuel continued until the summer of 2016 when Governor Andrew Cuomo signed legislation that legalized DFS in New York. Part of the law requires that all DFS operators pay the state a 15% tax on gross revenues.

Massachusetts took a lighter view of daily fantasy sports. This state fully legalized daily fantasy sports and created a regulatory structure for the practice. Massachusetts does not require DFS operators to pay any tax on revenues.

Daily fantasy sports in Nevada is subject to similar regulation as the state’s casinos. Every DFS operator in Nevada must have an active gambling operators license in order to be legal. That said, there are currently no daily fantasy sports companies operating in NV.

California has considered legalizing daily fantasy sports in the past. Sadly, nothing has come out of this just yet. It’s a potentially massive US online gambling market, but nothing has been done yet.

Online Gambling USA History

The internet is still quite young. So are online casinos. The first online gambling sites in the world launched around 1994. These sites were based offshore but still allowed US players to gamble.

Regulation soon followed. In 1996, an organization was created called the Kahnawake Gaming Commission. This regulatory body was created by a First Nations group in Canada. It sought to regulate online casino and online poker sites in North America. This was done by issuing licenses.

By the late 1990s, online gambling had exploded from just a few sites to hundreds of online gambling websites. Some estimates place the total revenue for online gambling higher than $800 million just in the years leading up to 1998.

American Lawmakers Take Notice

In true American fashion, laws were slow to catch up to online gambling in the US. In 1999, lawmakers in the Senate tried to ban online gambling via the the Internet Gambling Prohibition Act. This bill did not pass.

Not until 2002 was the introduction of official legislation that essentially banned all online gambling in the United States. The decision was complex and took some debate between several different US courts including the Supreme Court. In the end, the Federal Wire Act was passed. It declared that online gambling in the US was a crime. By 2004, major search engines had pulled all online gambling advertising from their platforms. The gambling industry in the United States effectively died out after this happened.

Unlawful Internet Gambling Enforcement Act Passes

USA online gambling faced more scrutiny as years passed. By the fall of 2006, another bill had passed in Congress that further restricted online gambling in the US. Known as the Unlawful Internet Gambling Enforcement Act (UIGEA), this bill made it illegal for American banks to process any transactions related to online gambling. This forced almost all major online gambling operators to pull out of the US online gambling industry.

Despite US laws, online gambling providers continued to thrive offshore. Most accepted US-based players. As offshore companies not subject to US rules, these gaming operators avoided the new banking restrictions.

At this point, estimates suggest that the worldwide online gambling market had generated more than $21 billion in just under 15 years of operation.

The Black Friday of Online Poker

Don’t confuse this with your favorite sales holiday. Online poker’s Black Friday was not a good day for poker enthusiasts.

Major online poker providers were accused of violating the terms of the UIGEA, In April of 2011. Included in the indictment were major sites like PokerStars, Absolute Poker, and Full Tilt. As a result, access to these sites from the US was restricted. Many believed that the potentially massive US online poker market died that day.

Some good did come out of this indictment. As part of the legal proceedings, it became clear that Full Tilt had taken money from players unfairly. Ultimately, PokerStars bought out Full Throttle and paid back every cent players took.

The Federal Wire Act

In 2011 the Federal Wire Act was called into question, years after it had initially passed. The United States Department of Justice released a legal statement claiming that the bill should only apply to sports bets. This was the first positive step towards legalizing online lottery, online casino, and online poker in the United States.

New Legal Online Gambling US

In the end, the legality of online USA gambling was left up to each US state to decide.

Delaware was the first state to legalize online USA gambling when it passed the Delaware Gaming Competitiveness Act in mid 2012.

Nevada followed close behind. This US state specifically legalized online poker in early 2013. New Jersey was just a few weeks behind. NJ legalized online poker and online casinos as long as they partnered with legal Atlantic City casinos.

It took less than a year for most of these US states to get their online gambling programs up and running. The first legal online USA gambling site in the country launched in Nevada in the spring of 2013. By winter of that same year, NJ and DE had also launched their online gambling sites.

Pennsylvania followed a few years later. In 2017, PA became the largest US state yet to pass a law that legalized and regulated online gambling. PA online casinos launched in 2019.

It remains to be seen what the future of US online gambling sites looks like. So far, the latest precedents have held. That said, the DOJ did release another legal statement on the Federal Wire Act in 2019. This statement has yet to be fully evaluated.
